(Oral) The challenge in this writ petition filed under Articles 226/227 of the Constitution of India, of the inaction of respondents No.1 to 7, where, they have failed to remove the illegal encroachment over the Johar/pond of the village by respondents No.8 to 20 and other persons. 2.
After arguing for sometime, learned counsel for the petitioner states that since disputed questions of fact are involved, therefore, he may be allowed to withdraw the present writ petition with liberty to the petitioner to take recourse to the remedies by way of civil suit, in accordance with law.

Dismissed as withdrawn. It shall, however, be open to the petitioners to take recourse to the remedies available to him, in accordance with law.
