The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking setting aside of order dated 17.01.2017 whereby respondent No.6 to 11 have been deputed for Intermediate School Course.

The petitioners are disputing selection of respondents No.6 to 11 for Intermediate School Course which commenced w.e.f. 21.01.2017. Indubitably, the respondents No.6 to 11 have already undergone said course because its duration was three to six months. The petitioners except Virender Kumar and Chet Ram have already retired. 3.

Learned counsel for the petitioners submits that petitioners belong to SC Category, thus, they are entitled to out of turn promotion as per State Policy of 2018. The State has decided to clear backlog from 1995.

Learned State counsel submits that competent authority must have considered petitioners for out of turn promotion as per State Policy of 2018 and if they have not been considered, they would be considered in accordance with law.

Without commenting on merits with regard to Intermediate School Course, the petition stands disposed of. The Court is sanguine of the fact that the competent authority would consider claim of petitioners qua out of turn promotion as per State Policy of 2018. 6.
