State of Punjab and others .............Respondent CORAM: HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.S.L.Chander Shekhar,Advocate for the petitioner Mr.Yatinder Sharma,Addl.AG Punjab for official respondents Jaswant Singh,J.(Oral) The petitioner is a resident of Village Laukha,Tehsil Patti, District Tarn Taran and his grievance is that although unauthorised construction from a public street was got removed by the BDPO Patti in compliance of the order dated 10.6.2007 (P-3) passed by SDM Patti on a complaint under Section 133 Cr.PC, however, the malba was never removed from the site causing a great source of nuisance to the locality.

Upon notice, Rassal Singh, BDPO,Block Patti has filed his reply by way of affidavit dated 13.5.2015. Copy of the same has been furnished to the counsel for the petitioner. The said reply/affidavit is taken on record.

In para 6 of the preliminary submissions of the affidavit/ RAJINDER PRASHAD JOSHI 2015.05.14 15:41 I attest to the accuracy and authenticity of this document High Court, Chandigarh.

CWP 6271/2015 reply it is stated that the illegal encroachment/possession of the common public street bearing khasra no.316 has been removed in the presence of the petitioner.

Counsel for the petitioner states that his client, in the light of subsequent development, as stated in the affidavit, is satisfied and therefore, he fairly submits that the present writ petition has become infructuous.

Disposed of as infructuous.
