By way of present petition, prayer has been made for directing respondents to take a final decision on charge-sheet dated 05.03.2020 (P-5) and 12.03.2020 (P-6) and to release the retiral benefits of the petitioner.

Learned counsel for the petitioner submits that in spite of the inquiry report finally having been submitted by the inquiry officer exonerating the petitioner in relation to the charge-sheet dated 05.03.2020 (P-5) and 12.03.2020 (P-6), no final decision is being taken by the respondents. 3.

The petitioner has attained superannuation and retired on 30.04.2021, and his retiral benefits are yet to be paid on account of pendency of the aforesaid enquiries.

It is settled law that enquiries in relation to persons who have attained superannuation ought to be completed expeditiously and within a period of 3 months.

No reasons are coming forth from the respondents for not passing final orders.

It is directed that final order be passed in relation to the inquiry report already submitted by the inquiry officer on 04.08.2021 within a period of 2 weeks henceforth and thereafter pass necessary orders for release of retiral benefits of the petitioner accordingly. 7.

Writ Petition stands disposed of.

It is made clear that if compliance is not made by the respondents, the petitioner shall be free to initiate contempt proceedings without any further notice to the Court.
