(Oral) The plaintiffs have knocked at the door of this Court by way of filing this revision petition against order dated 24.7.2019, passed by Civil Judge (Junior Division), Gurugram, vide which the defendants have been allowed to file written statement after expiry of more than 90 days, after service of defendants. I have heard learned counsel for the revisionist, besides going through the record and I find that the impugned order passed by the trial Court is well reasoned and does not suffer from any illegality BANITA CHUGH 2019.08.28 17:12 I am the author of this document
CR No. 4963 of 2019 -2or infirmity, much less apparent on the face of it. The order is not arbitrary or perverse. As regards the authority referred to by learned counsel for the revisionist i.e. M/s SCG Contracts India Pvt. Ltd. vs. K.S. Chamankar Infrastructure Pvt. Ltd. and others 2019 (4) SCALE 574, the same is not applicable due to different facts and circumstances, as well as the context in which such observations have been made.
Thus no ground is there to upset the impugned order, by way of accepting the revision petition. The petition is dismissed accordingly.
