Through instant petition preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ especially in the nature of mandamus directing the respondents to release the payment of exgratia as well as DCRG, in view of instructions issued by government from time to time by applying the formula as applicable and also to release the complete service benefits of his father to him.

At the very outset of the arguments, learned counsel for the petitioner submits that though legal notice dated 01.06.2018 (P-1) was duly served upon the respondents but till date neither any response has been received nor any conscious decision has been taken thereon. He further submits that petitioner feels satisfied in case direction is issued to respondent No.3 to decide legal notice (P-1) within a stipulated period. Without expressing any opinion on the merits of the case, instant petition is disposed of with a direction to respondent No.3-Executive Officer, Municipal Council, Fazilka, District Fazilka to consider the case unfolded by the petitioner in legal notice (P-1) and to take a conscious decision in accordance with law, rules and instructions issued by government from time to time, within a period of three months from the date of receipt of certified copy of this order.

However, if petitioner still feels aggrieved by any order of the aforesaid authority, he shall be at liberty to approach this Court or to have recourse to the other remedies available under law.
