(Oral) The present petition has been filed under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 for issuance of appropriate directions/orders holding the action of respondents in conducting multiple enquiries and now again entrusting enquiry to respondent No. 5 in case FIR No.34 dated 12.03.2023 under Sections 304-A, 279, 427 IPC (Sections 302, 506, 148, 149 IPC added later on) registered at Police Station Shri Hargobindpur, Police District Batala, District Gurdaspur despite the fact that SIT has already conducted detailed enquiry and thereafter with the intervention of this Court offence under Section 302 IPC was added in the FIR. A further prayer has also been made to restrain respondent No. 5 from conducting repeated enquiries on the representation of the accused as the matter has already been enquired into and investigated by SIT. Learned State Counsel, referring to paragraphs 4 to 8 of the status report dated 30.09.2024, submits that the investigation in FIR No. 34 has been carried out continuously and properly. Contrary to the petitioner's claims of multiple inquiries, no parallel investigations have been conducted. The investigation proceedings are diligently documented in the official case diary. The State counsel highlights that the SIT has conducted multiple raids on 05.09.2024, 10.09.2024, 13.09.2024, 14.09.2024, 18.09.2024, 20.09.2024, 21.09.2024, 22.09.2024, 24.09.2024, and 25.09.2024 at the residences of the accused and their relatives. Despite these efforts, the accused have evaded arrest.
The SIT has procured the accused's mobile numbers, and the Technical Support Unit, Batala, is analyzing CDRs, location data, and other technical information to aid in their apprehension. Non-bailable warrants have also been issued against the accused by the Learned JMIC, Batala, for 30.10.2024. Further, a Look-Out Circular (LOC) was issued on 26.09.2024 against the accused Narinder Singh and Rupinder Singh, residents of Bharath, Tehsil Batala, District Gurdaspur. The State Counsel emphasizes that the SIT is making persistent efforts to arrest the accused and conclude the investigation promptly. 3.
In view of the foregoing, nothing survives in the present petition and the same is disposed of as infructuous.
