Prayer in this writ petition filed by the petitioners under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondent authorities to sanction regular pay grade/scale of a regular chargeman (i.e. Rs.700-1200 - 1976; Rs.1800-3200 - 1986; Rs.6300-10700 - 1996) onwards as has been given to the employees who were junior to the petitioners. Further prayer has been made to direct the respondent authorities to regularize the services of the petitioners strictly in compliance with the order dated 03.12.2019 passed in CWP No.18782 of 1995, titled as "Subodh Kumar and others vs PSPCL and others" and thereafter, release 9/16/23 years time bound promotional scale to the petitioners along with arrears. Learned counsel for the petitioners, at the very outset, confines his prayer for deciding representation dated 23.05.2023 (Annexure P-11). He submits that at this stage, petitioners would be satisfied, if the said representation is decided by passing a speaking order within a time bound frame.

Mr. Saarib Aggarwal, Advocate for Mr. Manpreet S. Longia, Advocate, accepts notice on behalf of respondent No.1 and has no objection to the innocuous prayer made by learned counsel for the petitioners.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.1 to decide representation dated 23.05.2023 (Annexure P-11), submitted by the petitioners expeditiously, by passing a speaking order, preferably within a period of 03 months from the date of receipt of certified copy of this order.
