Learned counsel for petitioner when faced with judgment of Hon'ble the Supreme Court in Phoenix ARC Private Limited vs. Vishwa Bharti Vidya Mandir and others, 2022 (1) RCR (Civil) 888 and Division Bench of this Court in Fermina Developers Pvt. Ltd. and Anr. V. Indiabulls Housing Finance Ltd., 2023(1) PLR 489, seeks to withdraw this writ petition with liberty to petitioner to avail the remedy(ies) as may be available to him in accordance with law.

Writ petition is accordingly dismissed as withdrawn with liberty as aforementioned.
