By virtue of instant petition preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ in the nature of mandamus directing the respondents to grant service-cum-retiral benefits such as leave encashment, gratuity, dearness allowance, provident fund, revised pay scale, re-fixation of pay scale, pension and other benefits. And further to release all the service-cum-retiral benefits along with interest for delayed period in view of A.S. Randhawa v. State of Punjab and ors, and in view of instructions No.3/16/2014 3 FPPC/1359, dated 07.08.2014 (P-3). 2.

At the very outset of the arguments, learned counsel for the petitioner submits that though representation dated 20.04.2018 (P-2) was moved to the respondents but till date neither any response has been received nor any conscious decision has been taken thereon. Without expressing any opinion on the merits of the case, instant petition is disposed of with a direction to respondents particularly respondent No.4-Executive Officer, Municipal Council, Abohar, Fazilka to consider the case unfolded by the petitioner in representation (P-2) and to take a conscious decision in accordance with law, rules and instructions issued by government from time to time, within a period of three months from the date of receipt of certified copy of this order.

However, if petitioner still feels aggrieved by any order of the aforesaid authority, he shall be at liberty to approach this Court or to have recourse to the other remedies available under law.
