S.J. VAZIFDAR, ACTING CHIEF JUSTICE (Oral):

The petitioners claim to be entitled to be allotted shops in the New Sabzi Mandi at the reserve price before the premises are auctioned. They claim to be allotted the premises at a concessional rate. Many of the shop premises were auctioned in the month of January, 2016. The petitioners have not even made any application or representation in this regard to the respondent(s) concerned. They ought to do so in the first instance. The petition is accordingly disposed of with liberty to the petitioners to make their applications to the respondents in the first instance. The applications/representations, if made, shall be considered and decided in accordance with rules within two weeks of the receipt of the representation by the petitioners.

The auction shall not be conducted in respect of the remaining sites till the decision and for a period of two weeks after the service of the decision upon the petitioners.
