G.S.SANDHAWALIA, J. (Oral) The petitioner seeks the benefit of re-designation as Junior Technician as per his technical post and qualification of ITI. Release of pay scale of `4020-6200 w.e.f. 23.01.2002 which is revised/corresponding pay scale of `140-300 and to grant revised scale thereof from time to time including the pay scale of 5910-20200 with grade pay of 2400/- in view of the qualification of Matric with ITI as per Punjab Government notification No. 2/29/90-F.P.I/5294 dated 15.06.1990 as allowed to similarly situated and as recommended by respondent no. 3 vide letter dated 18.12.2014 (Annexure P-6) and grant the petitioner all consequential benefits is also prayed for.

Counsel, at the outset, submits that representation dated 13.10.2014 (Annexure P-5) has already been served upon respondent no. 3 which was forwarded on 18.12.2014 (Annexure P-6) to respondent no. 2 but no action has been taken on the same. Thereafter, legal notice dated 19.11.2015 (Annexure P-10) has been served upon the respondents asking SHIVANI GUPTA 2016.04.06 14:47 I attest to the accuracy and integrity of this document Chandigarh

CWP No. 5558 of 2016 for the necessary relief. Counsel further submits that he would be satisfied if the same is decided within a time bound frame. Notice of motion.

Mr. R.S. Sidhu, AAG, Punjab accepts notice on behalf of the respondents. Copy of the writ petition has been supplied to him in Court. Keeping in view the limited relief sought, this Court is of the opinion that there is no need for the respondents to file reply. Accordingly, without commenting on the merits of the case and the entitlement of the petitioner, the writ petition is disposed of with a direction to respondent no. 2 to take action on the legal notice dated 19.11.2015 (Annexure P-10) and the recommendation which has been made within a period of 3 months from the date of receipt of certified copy of the order. Needless to say if the relief is to be denied, a reasoned order be passed and conveyed to the petitioner.
