G.S.SANDHAWALIA, J. (Oral) Admittedly, the appeal is pending before the Commissioner and merely because the Sanad Takseem has been issued during the pendency of the proceedings, would not be as such a ground to issue directions to put the petitioner in possession of his share as prayed for. It is to be noticed that the appeal is against the preparation of the Naksha and the case is at initial stage. The directions, thus, which are sought do not fall within the ambit of the discretionary relief which this Court would like to exercise in the facts and circumstances. Even otherwise, it was always open to the petitioner to approach the Financial Commissioner, who is the highest authority rather than approaching this Court.
