Dated Police Station Sections 01.02.2023 Sadar, Raikot 304-A & 34 IPC Seeking issuance of appropriate directions to the official respondents to conduct fair, proper and impartial investigation in the FIR captioned above, petitioner has come up before this Court by filing the present petition under Section 528 BNSS. 2.

On instructions from ASI Balwinder Singh, counsel for the State submits that cancellation report has been filed.

At this stage, petitioner's counsel submits that he be given liberty to file a protest petition before the concerned Court with a clarification that cancellation report be not accepted without affording him an opportunity to file protest petition. 4.

Given above, petition is disposed of as withdrawn with liberty to file a protest petition before the concerned Court. It is clarified that the trial Court shall not accept the cancellation report without affording the petitioner an opportunity to file protest petition. It is further clarified that if the cancellation report is filed, the complainant may also file protest petition within 30 days from today. Pending application, if any, stand disposed of.
