Through instant petition preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ especially in the nature of mandamus directing the respondents to consider the claim for grant of ex-gratia benefits, financial assistance along with other culminating benefits with all arrears along with interest @ 12% p.a. 2.

At the very outset of the arguments, learned counsel for the petitioner submits that though petitioner served legal notice dated 07.09.2010 (P-5) upon the respondents followed by representation dated 03.07.2018 (P-8) but till date neither any response has been received nor any conscious decision has been taken thereon. He further submits that petitioner feels satisfied in case direction is issued to respondent No.2 to decide representation (P-8), within a stipulated period.

Without expressing any opinion on the merits of the case, instant petition is disposed of with a direction to respondent No.2-Chief Engineer, Panchayat, Panchayati Raj, Public Works Haryana, Chandigarh to consider the case unfolded by the petitioner in representation (P-8) and to take a conscious decision within a period of three months from the date of receipt of certified copy of this order.

However, if petitioner still feels aggrieved by any order of the aforesaid authority, she shall be at liberty to approach this Court or to have recourse to the other remedies available under law.
