(ORAL) Through this petition, the petitioner seeks regular bail in case bearing FIR No.228 dated 17.05.2021 registered under Section 20 (Section 20-B added later on) of Narcotics Drugs and Psychotropic Substances Act, 1985, Section 188 of IPC and Section 51 of Disaster Management Act, 2005 at Police Station Narnaund, District Hansi.

Learned counsel for the petitioner states that the petitioner being a lady has been falsely implicated in the present case. No recovery has been effected from the petitioner. However, the alleged recovery has been effected from the house of the co-accused namely Rajbir that too in his absence. Petitioner has been in custody since 05.06.2021. Learned counsel for the State while opposing the prayer of the petitioner for grant of bail, has stated that as huge recovery has been effected from the house of the co-accused and the petitioner has actively participated in the present case. I have heard the learned counsel for the parties. No recovery has been effected from the petitioner rather it has been effected from the house of the co-accused even in his absence. Petitioner has been in custody since 05.06.2021. Prosecution witnesses are yet to be examined. The trial is unlikely to conclude any time soon. Therefore, no useful purpose would be served by keeping the petitioner behind the bars. In view of the above, without commenting anything on the merits, lest it should prejudice the case of either side, the present petition is allowed and the petitioner is ordered to be released on bail on her furnishing bail and surety bonds to the satisfaction of the learned trial Court/Duty Magistrate.
