The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered against him vide FIR No.

222 dated 19.9.2021 at Police Station Tanda, District Hoshiarpur, Punjab under Sections 379-B and 34 of Indian Penal Code.

At the time of issuance of notice of motion the following order was passed on 14.10.2021:

"The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR

- 2 - No.222 dated 19.9.2021 at Police Station Tanda, District Hoshiarpur, Punjab under Sections 379-B and 34 of Indian Penal Code, wherein the complainant Barinder Singh, Field Officer, RBL Finance Company, Dasuya has alleged that on 18.9.2021, three unidentified persons snatched a bag from him, which contained a cash amount of Rs.64,530/-; a computer TAB and a receipt book.

Learned counsel for the petitioner submits that the petitioner is nowhere named in the FIR and has been nominated on the basis of a disclosure statement made by a co-accused, which would hardly carry any evidentiary value. Notice of motion for 11.3.2022.

Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join investigation as and when called upon to do so and cooperate with the Arresting/Investigating Officer and shall abide by the conditions as provided under Section 438(2) Cr.P.C."

Learned State counsel has informed that pursuant to aforesaid directions, the petitioner has joined investigation and he is not required for custodial interrogation. It has also been informed that the petitioner is wanted in four other cases. 4.

Having regard to the aforestated position wherein the petitioner has joined investigation and is not required for any custodial interrogation, the petition is accepted and interim directions issued by this Court vide order dated 14.10.2021 are hereby made absolute subject to the condition that the petitioner shall join investigation as

- 3 - and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.
