**** RITU BAHRI, J. (Oral) Petitioner is seeking direction to the respondents to release the payment of pensionary benefits on account of superannuation on 29.02.2008.

Short written statement has filed on behalf of respondent No.2 and the same is taken on record. It has been stated in the written statement that the petitioner has already been paid all the dues i.e. pay and pensionary benefit along with 8.70% interest on all the delayed payments as per prevailing instructions of the Government.

CWP No.6454 of 2015 -2Perusal of the written statement shows that an amount of `7,91,676/- has been paid as interest to the petitioner. It is not the case of the respondents that the petitioner was facing any disciplinary proceedings or any recovery has been effected from him.

At this stage, no interference is required to be made on the rate of interest, however, keeping in view the fact that the petitioner after being superannuated in the year 2008 was made to suffer almost seven years to get his retiral dues, the present petition is disposed by giving directions to the respondents to make a payment of `50,000/- as costs to the petitioner, within a period of one month, from the date of receipt of certified copy of this order and thereafter the compliance report be sent to this Court.
