***** Rakesh Kumar Jain, J. (Oral) The petitioner is a Sarpanch who has been put under suspension vide order dated 09.10.2017 against which he has filed the appeal along with an application for stay, which has been declined by the impugned order dated 02.11.2017.
Counsel for the petitioner submits that the petitioner has a good case on merits as the allegation against him is only regarding sale of some trees for which the petitioner has already paid an amount of `34,400/-. After hearing learned counsel for the petitioner, examining the available record and keeping in view the facts and circumstances and especially the fact that the main appeal itself is fixed for 21.12.2017, the present petition is hereby disposed of with a liberty to the petitioner to file an application for pre-ponement of the date of hearing in the main appeal from 21.12.2017 to an early date and if such an application is filed along with copy
