RAMESHWAR SINGH MALIK, J Learned counsel for the petitioner, at the very outset, fairly states that since during the pendency of the writ petition, his statuary appeal has been decided by the appellate authority, the present writ petition may be disposed of, as having been rendered infructuous, however, with a direction to respondent no.1 not to destroy the record of the petitioner till the matter is finally concluded, because the petitioner is yet to get requisite information from respondent no.1.
Faced with the above, learned counsel for respondent no.1 submits that an appropriate application has already been moved before the appellate authority on behalf of respondent no.1 for recalling the order passed in the appeal of the petitioner. CWP No.7701 of 2014 disposal of the writ petition, as suggested by learned counsel for the petitioner. In view of the above respective stands taken by learned counsel for the parties, instant writ petition is disposed of, with a direction to respondent no.1 not to destroy the record of the petitioner till the matter is finally concluded. However, it is made clear that respondent no.1 shall be at liberty to pursue its application pending decision before the appellate authority, who has decided the appeal of the petitioner.
Disposed of, accordingly.
