Through instant petition preferred under Article 226/227 of the Constitution of India, petitioners have sought issuance of a writ especially in the nature of mandamus directing the respondents to grant arrears of three installments of dearness relief/allowances, 6% dearness allowance due from 01.07.2015 to 31.12.2015 (6 months), 6% from 01.01.2016 to 31.10.2016 (10 months) and 7% from 01.07.2016 to 01.12.2016 (6 months) and three installments of DA/DR one from 01.01.2017 and from 01.01.2018. 2.

At the very outset of the arguments, learned counsel for the petitioners submits that though petitioners moved representation dated 30.05.2018 (P-4) to the respondents followed by legal notice dated 01.07.2018 (P-5) but till date neither any response has been received nor any conscious decision has been taken thereon.

Learned counsel for the petitioners further submits that petitioners feel satisfied in case direction is issued to respondent(s) to decide representation (P-4) as well as legal notice (P-5), within a stipulated period. 4.

Without expressing any opinion on the merits of the case, instant petition is disposed of with a direction to respondents particularly respondent No.2-Principal Secretary, Government of Punjab, Department of Finance, Civil Secretariat, Punjab, Chandigarh to consider the case unfolded by the petitioners in representation and legal notice (P-4 and P-5 respectively) and to take a conscious decision, within a period of three months from the date of receipt of certified copy of this order.

However, if petitioners still feel aggrieved by any order of the aforesaid authority, they shall be at liberty to approach this Court or to have recourse to the other remedies available under law.
