(Oral) The petitioner has approached this Court under Article 226 of the Constitution of India, seeking quashing of the Excise Policy of Punjab State (wrongly mentioned as 'Haryana') for the year 2016-17 (appended as Annexure P-9) issued by the Excise and Taxation Commissioner, Punjab, being ultra vires and against the dictum of this High Court, as laid down in CWP No. 25777 of 2012, titled as, "Arrive Safe Society Vs. National Highways Authority of India and others", decided on 18.03.2014 (Annexure P-3).

It was not disputed that the challenge was to the Excise Policy and the validity period has since ended on 31st March, 2017. Therefore, it was submitted by the leaned counsel for the petitioner that by efflux of time, the present writ petition has been rendered infructuous and may be disposed of as such.
