(Oral) The petitioner has laid challenge to the order dated 15.01.2016 passed by the Central Administrative Tribunal, Chandigarh Bench, whereby his three Original Applications questioning (i) the order dated 16.05.2007 for delegation of powers; (ii) charge-sheet dated 08.05.2009 and (iii) the punishment order dated 06.05.2009 have been dismissed.

CWP No.5655 of 2016 [2] It is not in dispute that against the punishment order, the petitioner filed a departmental appeal which was partly dismissed by the Appellate Authority vide order dated 28.08.2015 (P-35) as the Appellate Authority has reduced the penalty of dismissal from service to the penalty of compulsory retirement from service.
The above-stated Appellate order has not been challenged by the petitioner before the Tribunal. In this view of the matter, we dismiss the instant writ petition and relegate the petitioner to the equally efficacious remedy available before the Tribunal against the Appellate order, also with liberty to raise the additional issues taken up by him in this writ petition, if need be.
