IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP No. 26832 of 2017 Date of decision: 05.12.2017 Akal Saran Singh ....Petitioner(s)
Versus
State of Haryana and others
...Respondent(s)
CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA
Present:
Mr. Jitender S. Chahal, Advocate, for the petitioner.
G.S.SANDHAWALIA, J. (Oral) The petitioner seeks direction for consideration of his claim for re-engagement as Classical & Vernacular (C & V) Art and Craft Teacher till the end of academic session upto 31.03.2018. The claim is based on the policy dated 16.11.2016 for re-engagement of retired teachers from Haryana Government Service (Annexure P-1).
It is the case of the petitioner that he has retired from service on 30.09.2017 on superannuation from Government Senior Secondary School, Mustafabad. Due to good service record, he had applied for re-employment as per Annexure P-2 and also through the MIS portal which had been launched. Reference is made to the acknowledgement dated 24.08.2017 (Annexure P-3 colly). It is his case that one post from where he retired was lying vacant and that he had also filed a representation dated 09.10.2017 (Annexure P-4) with respondent no. 2 but no action has been taken. Resultantly, the present writ petition has been filed. Counsel accordingly submits that he would be satisfied if the said representation is decided within a fixed time frame.

CWP No. 26832 of 2017 Notice of motion.
Ms. Shruti Jain Goyal, AAG, Haryana accepts notice. Copy of the writ petition has been supplied to her.
Keeping in view the above, this Court is of the opinion that no useful purpose would be served to ask the respondents to file reply as the decision making process is still pending.
Accordingly, without commenting on the merits of the case or the entitlement of the petitioner for the abovesaid relief and keeping in view the fact that the matter is still pending consideration, the present writ petition is disposed of with a direction to respondent no. 2 to take a decision on the representation dated 09.10.2017 (Annexure P-4) within a period of 3 weeks from the date of receipt of certified copy of the order. In case any adverse order is to be passed, a reasoned order be passed and conveyed to the petitioner.
