The petitioner seeks grant of anticipatory bail in respect of aforementioned FIR.

At the time of issuance of notice of motion on 03.08.2023, this Court passed the following order:

"Learned counsel for the petitioner submitted that complaint was filed by the Sarpanch of the village due to political enmity. He submitted that even otherwise the allegation is with regard to theft of seven wooden pieces of Khair tree. He further submitted that the petitioner is not involved in any other case and has clean antecedents. Notice of motion.

Mr. Naveen Kumar Sheoran, learned DAG, Haryana accepts notice on behalf of the State and prays for some time to file affidavit in the present case.

Adjourned to 07.12.2023.

CRM-M-37670-2023 (O&M) -2Meanwhile, the petitioner is directed to appear before the Arresting/Investigating Officer and join the investigation and thereafter also as and when called upon to do so. In the event of arrest, the petitioner shall be released on interim bail subject to furnishing personal bond/surety bond to the satisfaction of Arresting/Investigating Officer. The petitioner shall abide by all the conditions as provided under Section 438 (2) Cr.P.C."

Learned State counsel upon instructions has informed that pursuant to interim directions issued by this Court, the petitioner has since joined investigation and is not required for any custodial interrogation and that he is not wanted in any other case.

Having regard to the aforestated position, wherein the petitioner is stated to have joined investigation and is not required for any custodial interrogation and otherwise has a clean record, the petition is accepted and the interim directions issued by this Court vide order dated 03.08.2023 are hereby made absolute subject to the condition that the petitioner shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C. 13.03.2024 (GURVINDER SINGH GILL) Vimal JUDGE Whether speaking/reasoned: Yes/No Whether reportable:
