JASGURPREET SINGH PURI , J. (ORAL ) The present petition has been filed under Section 438 of the Code of Criminal Procedure (for short 'the Cr.P.C.)' praying for grant of anticipatory bail in FIR No.0045 dated 02.07.2019, under Sections 323, 324, 148 and 149 IPC (Section 326 IPC added later on), registered at Police Station Tibber, District Gurdaspur.

CRM-M-33505-2019 (O&M) the petitioners gave datar blows on the complainant namely Paramjit Singh. Initially the FIR was registered under Sections 323, 324, 148 and 149 IPC and thereafter on the basis of the report based upon the MLR, Section 326 IPC was added.
On 20.11.2019, interim protection was granted to petitioner Nos.2 to 5, subject to his joining investigation and complying with the provisions contained in Section 438 (2) Cr.P.C. However, the petition for the grant of anticipatory bail qua petitioner No.1 Gurpreet Singh was dismissed as withdrawn.
Learned State counsel, on instructions from SI Abdesh Singh, states that in pursuance of order dated 20.11.2019, petitioner Nos.2 to 5, have joined investigation and have fully cooperated with the investigation process. He further states that the petitioners are no longer required for further custodial interrogation. In view of above stand taken by the learned State counsel, the present petition is allowed. Interim order dated November 20, 2019, is hereby made absolute qua petitioner Nos.2 to 5 only. Since the main relief has been granted, misc. application is disposed of as having rendered infructuous.
