Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.167 dated 26.06.2019 under Sections 308, 323, 34 and 506 IPC, registered at Police Station Jamalpur, District Ludhiana.

I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. The allegations against the petitioner is that he gave an injury with iron rod on the head of the complainant, which resulted in fracture of frontal bone.

Learned counsel for the petitioner states that during the pendency of the proceedings, the matter has been compromised between the parties.

Learned counsel for the complainant has affirmed the factum of the compromise.

The investigation in the case is complete. The challan has already been presented. The petitioner has been in custody since 03.07.2019, Without commenting anything on the merits of case and also in view of the compromise between the parties, in my opinion, no useful purpose will be served by detaining the petitioner during trial. The petition, as such, is accepted. Petitioner Rahul is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate, concerned.
