**** HARSIMRAN SINGH SETHI , J. (ORAL) Present petition has been filed by the petitioner seeking the relief of release of the pensionary benefits as well as interest on the delayed payment already made to him.

Counsel for the petitioner states that no pensionary benefit has been released so far. Further, there is no impediment in release of the pensionary benefits and the same are being withheld arbitrarily by the respondents.

Counsel for the petitioner further states that, at this stage, the petitioner will be satisfied in case a time bound direction is given to the respondents to decide representation dated 20.08.2018 (Annexure P-2). CWP-25122-2018 -2In view of the statement made by the counsel for the petitioner, without expressing any opinion on the merits of the case and the claim being made in the said representation dated 20.08.2018 (Annexure P-2), the present petition is disposed of with a direction to the respondents to decide the representation dated 20.08.2018 (Annexure P-2), by passing a speaking order, within a period of three months from the date of receipt of a certified copy of this order. In case, after the decision it is found that the petitioner is entitled for any monetary benefits, the same should also be released to him within a period of next two months. While passing the speaking order, the respondents will keep in mind the judgment of this Court passed in case A.S. Randhawa Vs. State of Punjab, 1997(3) SCT 468.
