(Oral) The present criminal appeal is filed under Section 341 Cr.P.C against the impugned judgment dated 31.05.2023 passed by Learned Additional Sessions Judge, Faridabad whereby the application filed by the respondent under Section 340 read with section 195 of Cr.P.C for initiating criminal proceeding against appellant herein for offences under section 181,182,191, 193, 199 and 209 of IPC for knowingly and deliberately making false statements, declarations and furnishing false evidence and information etc. has been allowed and directed the Reader of the Court to file a complaint before the court of Learned Chief Judicial Magistrate, Faridabad, to set the criminal law in motion against the appellant. Learned counsel for the respondent submits that he has no objection if the present appeal is allowed. He submits that in fact no false statement was made by the appellant before the learned Court below. It is submitted that most likely there was miscalculation and there was no mis-representation on behalf of the appellant. Learned counsel for the petitioner submits that in view of the above, the present appeal be allowed and the impugned judgment dated 31.5.2023 be set aside.
