The present petition has been filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the petitioner in FIR No.144 dated 02.11.2020 under Sections 465, 467, 468, 469, 471, 177 of the Indian Penal Code, 1860 registered at Police Station Amloh, District Fatehgarh Sahib.

Learned counsel for the petitioner has contended that the present FIR is the result of a financial dealing between the parties. He would further contend that qua the said recovery, a civil suit had also been filed by the complainant in the year 2017. It has further been contended by learned counsel for the petitioner that now the parties have since compromised the matter and in fact the civil suit for recovery has also been withdrawn.

CRM-M-39521-2020 (O&M) -2Mr. Rajinder Goyal, learned counsel for the complainant has reiterated the fact that the matter has been compromised between the parties.

In view of the above and without commenting upon the merits of the case and considering the fact that the matter has been compromised between the parties and the present FIR was the result of a financial dealing between the parties, I deem this to be a fit case to grant the concession of regular bail to the petitioner. The petitioner is directed to be released on bail subject to his furnishing bail bonds/surety bonds to the satisfaction of the Illaqa Magistrate/Duty Magistrate/Trial Court concerned.

However, the Prosecution will always be at liberty to apply for cancellation of bail in case the petitioner is found to be misusing the concession of bail in any manner.

It is, however, made clear that any observation made herein shall not be treated as an expression of opinion on the merits of the case. Disposed off. No separate order needs to be passed on the pending applications which also stand disposed off.
