This is a second contempt petition filed under Article 215 of the Constitution of India and Sections 11 and 12 of the Contempt of Courts Act, 1971 for initiation of contempt proceedings against the respondents. 2.

Brief facts relevant to the present lis are that the petitioner herein filed CWP-8433-2025 titled as 'Inder Preet Singh V/s State of Punjab & Anr.' which was disposed off by the Hon'ble Division Bench of this Court on 27.03.2025 and the following order was passed : 'Disposed of with a direction upon the respondent(s) concerned, seized with the representation(s) (Annexures P-2 and P-3) to, within a period of one month from today, make a lawful decision thereons, but after hearing all the affected persons concerned'.

-2Thereafter a contempt petition being COCP-2344-2025 titled as 'Inder Preet Singh V/s Tejveer Singh & Anr.' came to be filed by the petitioner on the ground that the order of the High Court had not been complied with. Vide order dated 19.05.2025 the said contempt petition was disposed off and the following order was passed : '1. This is a petition under Sections 11 and 12 of the Contempt of Courts Act, 1971 for willful disobedience of order dated 27.03.2025 passed in CWP-8433-2025, directing the respondents to decide the representation filed by the petitioner within a period of one month.

2. Ms. Kavita Arora, Advocate has put in appearance on behalf of respondent No.2 and has filed her power of attorney, which is taken on record. She has stated that a speaking order has been passed on 16.05.2025, copy whereof has been handed over to the petitioner.

3. Faced with the same, the petitioner seeks permission to withdraw the present petition. Permitted to do so.

4. Dismissed as withdrawn. Pending applications, if any, also stand disposed off.'

Now the present second contempt petition has been filed on the ground that the copy of the order was given in the form of an affidavit to the petitioner, which is a patently false affidavit inasmuch as a wrong statement has been made regarding the payments. The learned counsel further states that the payments have not been correctly dealt with.

Learned counsel for respondent No.2 states that only a speaking order was passed which was handed over to the petitioner - Mr. Inder Preet Singh - on 19.05.2025.

In the present case the Hon'ble Division Bench of this Court vide order dated 27.03.2025 disposed off the writ petition being CWP-84332025 with a direction that the representations i.e. Annexures P-2 and P-3 appended with the writ petition be decided within a period of one month after hearing all the affected persons. In the first contempt petition being COCP-2344-2025 filed by the petitioner, where he appeared in person, it was noticed that a speaking order had been passed in due compliance of the order dated 27.03.2025 passed in CWP-8433-2025 on 16.05.2025 and a copy whereof had been handed over to the petitioner. Hence the said contempt petition was dismissed as withdrawn. 7.

In the present second contempt petition what the petitioner is seeking is to challenge the speaking order dated 16.05.2025 passed by respondent No.2 which is not within the jurisdiction of this Court in a contempt petition. The correctness of the speaking order cannot be challenged in a contempt petition. If the petitioner is aggrieved by the speaking order, he is always at liberty to challenge the same in accordance with law.

In view of the above, I do not find any merit in the present contempt petition and the same being devoid of any merit is accordingly dismissed with ₹50,000 (rupees fifty thousand) as costs to be deposited in

-4the account of the Punjab & Haryana High Court Bar Association, Chandigarh for renovation of the Ladies' Bar Room. 9.
