Land of petitioners comprised in khasra no.15//12/1/2/2, 19/2/2/1 measuring 4 kanals with super structure/store running at the spot situated in Village Lakhnaur,H.B.No.36, Tehsil District Mohali,SAS Nagar was acquired vide Award No.556 dated 10.6.2015 for public purpose namely for the planned development and for setting up residential urban estate in the area of Tehsil Mohali,Distt.Rupnagar (now Mohali). It is alleged that the petitioners were not issued any notice whatsoever with regard to the acquisition and they are in settled business at the site for the last 20 years. They came to know about the Award only when on 16.7.2019 officials of GMADA visited the spot and warned the petitioners to vacate the premises and further threatened to demolish the structure. Further,it is inter alia alleged that respondents have violated the provisions of RAJINDER PARSHAD JOSHI 2019.08.22 10:19 I attest to the accuracy and integrity of this document

CWP 21824/2019 -2Chapter V to VIII of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act,2013. Accordingly, prayer has been made for quashing the impugned Award (P-4) and further to grant compensation in respect of acquired land/super structure as per current price and to allot commercial site of equivalent size of the property in question. At the time of hearing,learned counsel for the petitioners states that there are factual errors in petition and as such seeks permission to withdraw the petition with liberty to file a fresh one with complete particulars.
