The petitioner has prayed for extension of parole, already granted to him upto 08.10.2018, on the ground that his wife is expecting a child whose expected date of delivery is 22.10.2018.

Counsel for the petitioner has submitted that the parole, already granted to the petitioner, may be extended enabling him to be by the side of his wife at the time of her delivery and to take care post delivery. After hearing counsel for the petitioner and examining the available record, I am of the considered opinion that the parole granted to the petitioner cannot be extended at this stage because the petitioner has to surrender before the jail authorities on 08.10.2018, whereas the expected date of delivery of his wife is 22.10.2018, therefore, he cannot be allowed to remain out of the jail for such a long period on that count. However, he may apply for grant of parole again immediately before the date of delivery. Consequently, the present petition is hereby dismissed being denuded of any merit, though without any order as to costs.
