*** Ritu Bahri, J. (Oral) Petitioner has filed the present petition under Section 439 (2) Cr.P.C seeking cancellation of regular bail granted to respondent No. 2 in case F.I.R No. 02 dated 03.01.2020, under Section 376 (2) (N), 376-D IPC and Section 3 of Scheduled Castes and Scheduled Tribes (Prevention and Atrocities) Act, 1989. On a specific query put to learned counsel for the petitioner, he has not disputed that on 29.05.2019, a civil suit was filed by the complainant for declaration that agreement dated 21.05.2019 is null and void but the said suit was withdrawn by her on 18.09.2019.

In view of the above factual position, no ground is made out for cancellation of regular bail granted to respondent No. 2 by this Court, vide order dated 06.10.2020 (P-3).

Dismissed.
