***** Rakesh Kumar Jain, J. (Oral) Respondent No.3 is an elected Sarpanch. He has been placed under suspension in terms of Section 51 of the Haryana Panchayati Raj Act, 1994. The appeal filed by him was dismissed by respondent no.1 on 08.05.2018 with a direction to complete the regular inquiry within a period of one month.
However, counsel for the petitioner submits that the said inquiry has not even started till date and, thus, he prays that a direction may be issued to respondent no.2 to complete the regular inquiry within the time frame, as directed by respondent no.1.
After hearing learned counsel for the petitioner and examining the available record, I am of the considered opinion that in such type of cases, notice is not required to be issued to the respondents because the prayer made by the petitioner is innocuous as he is only praying for completion of the regular inquiry in terms of the direction issued by respondent no.1. Accordingly, the present petition is hereby disposed of with a direction to the Deputy Commissioner, Karnal to comply with the order dated 08.05.2018 passed by respondent no.1 in its letter and spirit.
