[ The aforesaid presence is being recorded through video conferencing since the proceedings are being conducted in virtual court ] **** JASWANT SINGH, J. (ORAL) By filing the present petition, the petitioner (Gram Panchayat, Village Bhangala, Tehsil Patti, District Tarn Taran) seeks issuance of a writ in the nature of mandamus directing the official respondent Nos. 1 to 6 to take action against private respondent Nos. 7 & 8 [ (7) The New Park Avenu Colony, Tarn Taran; and (8) The Victoria Colony, Tarn Taran ], who are developing illegal colonies by illegally occupying / usurping the religious properties owned by Bunga Bhangala and Samadh of Jathedar Akali Phoola Singh, situated in the village. It is, inter alia, averred that private respondent Nos.

7 & 8 are developing illegal colonies by occupying the religious properties without any approval from the competent authority. The Municipal Council, Tarn Taran (respondent No. 5) has also issued notices to them regarding closure the illegal work. The petitioner has also sent the representations / DINESH KUMAR 2020.12.

C.W.P. No. 21157 of 2020 (O&M) -2respondents. Since no action has been taken by the authorities against them, hence the present petition.

After arguing for some time, counsel for the petitioner realizing that the alternative remedy for filing a suit under Section 92 of Civil Procedure Code as well as other legal recourse are available in accordance with law with it, prays for permission to withdraw the present petition with the said liberty.
