This is third petition for grant of regular bail in a criminal case arising from case/Crime No. 29 dated 17.07.2018, registered under Section 8, 15, 29, 60 & 61 of the Narcotic Drugs & Psychotropic Substances Act, 1985, at Police Station Narcotics Control Bureau (NCB), Sector 25, Union Territory, Chandigarh.

The second petition (Criminal Misc. No. M-23287 of 2019) was dismissed on 30.10.2019 with the following order:- "Petitioner prays for bail pending trial in Crime Case No.29 dated 17.07.2018 registered under Sections 8, 15, 29, 60 and 61 of the Narcotic Drugs and Psychotropic Substances Act, Narcotic Control Bureau Zonal Unit, Chandigarh.

Learned counsel for the petitioner contends that petitioner has been nominated as an accused on the statement of co-accused which has also been retracted. Criminal Misc. No. M-39382 of 2020 On the other hand, reply by Intelligence Officer, Narcotics Control Bureau, Chandigarh has been filed giving details of investigation carried out and effort of the Investigating Agency to reach the origin from where consignment of the narcotics i.e. 299.100 Kg poppy husk started. Learned counsel for the UT Chandigarh submits that prosecution evidence is in progress and, therefore, the Court should not grant concession of bail.

Keeping in view the seriousness of the allegations and the fact that trial has already started, this Court is not inclined to grant concession of regular bail to the petitioner. Accordingly, the present petition is dismissed". Learned counsel for the petitioner contends that the petitioner is in custody since 08.12.2018 and the trial of the case has not made any substantial progress.

Keeping in view the aforesaid facts, the trial Court is requested to expedite the disposal of the case as it has been noticed that the prosecution has only recorded the deposition of five witnesses. With the observations made above, the present petition is disposed of.
