Mr. Vishal Garg Narwana, Advocate, for the petitioner --- TRIBHUVAN DAHIYA , J. (Oral) The instant revision petition under Article 227 of the Constitution of India has been filed for setting aside the order dated 2.12.2021 (Annexure P3) and the order dated 6.8.2022 (Annexure P-9). Vide order dated 2.12.2021 the petitioner/plaintiff's case was dismissed in default for his non-appearance. Subsequent order dated 6.8.2022 records that after the dismissal of the suit in default, the application for restoration was filed. Notice in the application was yet to be served upon the defendants. Therefore, early hearing of the application was declined.
Learned counsel for the petitioner has prayed that the trial Court be directed to advance the date of hearing on his application for setting aside the order, whereby suit was dismissed in default for non-appearance. No ground to interfere in the impugned order is made out. The restoration application is pending adjudication in which notice is yet to be served upon the defendants.
Dismissed.
