This is a civil writ petition filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to consider the claim of the petitioner for compassionate appointment.

The petitioner prays for considering the claim of compassionate appointment on account of death of his father, Government employee, who died on 09.11.2006. The petitioner's father had been dismissed from service, against which, he filed a civil suit, which was dismissed on 05.11.2003. The appeal was preferred which too was dismissed on 06.08.2004 and RSA4327-2005 has been filed before this Court, which is pending. While the said RSA is pending, the petitioner has claimed compassionate appointment and it cannot be said that the petitioner's father was in service as at no given point of time before his death, any order was passed for continuing him in service.

Keeping in view the above, the present petition is found to be wholly frivolous and accordingly, the same is dismissed. 4.
