(Oral) The petitioner is a resident of village Issa Panj Garain, Jawahar Singh Wale Jhugge, Tehsil Guruharsahai, District Ferozepur. He alleges that the Deputy Chief Executive Officer of Zila Parishad, Ferozepur has vide the impugned order dated 03.09.2015 (P-6) erroneously exercised the jurisdiction of Collector under the Punjab Village Common Lands (Regulation) Act, 1961 and ordered demolition of his cattle shed constructed within the abadi deh. It is further claimed that the above named Authority wrongly presumed that the cattle shed was constructed within the phirni area. The petitioner further seeks a direction for demarcation of phirni of his village and for construction of the road as per the proposal under consideration. The petitioner also alleges that no action is being taken against the persons who have actually encroached upon MOHINDER KUMAR 2016.04.22 11:38 I attest to the accuracy and integrity of this document Chandigarh

Having regard to the above-mentioned allegations and the fact that demarcation of village phirni would be in the interest of the entire village community, we dispose of this writ petition without expressing any views on merits, with a direction to the Deputy Commissioner, Ferozepur and the District Development and Panchayat Officer, Ferozeur to deploy a team of Revenue and Panchayat Department officials for demarcation of the village phirni, after advance notice to all concerned and take further action in accordance with law. The needful shall be done at the earliest but not later than two months from the date of receiving a certified copy of this order.

Ordered accordingly.
