Through the instant petition, prayer is made for issuing a mandamus upon the official respondents for conducting a fair and impartial inquiry in case FIR no.88, dated 31.08.2021, under Section 302 and 34 of the IPC (Sections 341, 452, 148 and 149 IPC added later on), registered at Police Station Mamdot, District Ferozepur, as the father of the present petitioner is alleged to have been murdered by respondent no.5.

During the pendency of the instant petition, much water has flown, and as per the directions issued by this Court vide order dated 01.04.2024, a fresh status report, was filed by the State on dated 30.04.2024, before this Court. A study survey of the said status report makes a categorical revelation that after the conclusion of the investigation, a final report has been filed, however, the offence punishable under Section 302 IPC, was recommended to be deleted, vide

CRM-M-43671-2021 -2zimni no.32, dated 09.04.2022.

At this stage, due to the aforesaid supervening events, this Court is not inclined to grant the asked for relief (supra), to the present petitioner. Consequently, the petitioner is relegated to the learned trial court concerned, in case the grievance of the petitioner still survives. 4.

Disposed of accordingly.
