Keeping in view the averments made in the application, which are duly supported by an affidavit, the application is allowed and delay of 100 days in filing the appeal is condoned.

After arguing for some time, learned for the appellant submits that even if the back wages are denied but, the period for which the appellant remained out, cannot be treated as non-duty period as it will cause prejudice despite being exonerated of the criminal charge, which fact has not been considered by the learned Single Judge hence, the present appeal may kindly KANCHAN 2026.07.02 16:42 I attest to the accuracy and integrity of this order/judgment
