Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.134 dated 22.07.2018 under Section 61 of the Punjab Excise Act, 1914, registered at Police Station Ajnala, District Amritsar Rural.
Notice of motion was issued. Learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per the allegations in the present case, two drums of 150 kgs. each of Lahan have been recovered from the spot. CRM No.M-34332 of 2019 -2per interim order passed by learned Addl. Sessions Judge, Amritsar, though, his application for anticipatory bail has been dismissed by that Court. It has been brought to the notice of this Court that challan has already been presented, which means, investigation is complete. Keeping in view above facts, the petitioner is only to face trial. The recovery has already been effected. The petitioner is not required for further investigation or interrogation.
In view of the above discussion, I find merit in the present case and the same is allowed. The petitioner is directed to surrender before the learned trial Court within 10 days from today and on doing so, he shall be released on bail by the learned trial Court to its satisfaction. However, it is made clear that if the petitioner fails to surrender within 10 days before the trial Court, then this petition shall be treated as dismissed.
