ASHWANI KUMAR MISHRA , J (ORAL) Petitioners are aggrieved by the demand notice issued to them on the ground that proper opportunity of hearing has not been afforded to them. An objection is taken to the maintainability of the writ on the ground of availability of statutory remedy of appeal. Learned State counsel also points out that notices were in fact, issued to the petitioners alongwith reminders. The counsel for the petitioners objects to it on the ground that proper opportunity of hearing is denied to the petitioners.

Be that as it may, in view of the fact that the petitioners have remedy of filing appeal against the impugned recovery Certificate, we are not inclined to entertain, thus the petition is dismissed.

However, if such an appeal is preferred within a period of two weeks from today, the same shall be entertained without raising any objection with regard to limitation in filing the appeal.
