Notice of motion. On our asking, Ms. Kirti Singh, DAG Haryana accepts notice on behalf of respondents No.1 to 4. Since no order prejudicial to the interest of respondents No.5&6 is being passed, there is no necessity to issue notice to those respondents and call upon other respondents to file their reply/affidavit at this stage.

The petitioners' grievance is against inclusion of names of respondents No.5&6 in the Voter-List of Village Rojka Mew, Tehsil Nuh, District Mewat. They have raised various factual issues in support of their contention against inclusion of abovenamed respondents in the Voter-List. Such issues certainly need not be gone into by this Court in exercise of writ jurisdiction, more-so when there is an effective mechanism provided under the relevant laws.

The writ petition is accordingly disposed of with a direction to the Deputy Commissioner-cum-District Election Officer, Mewat to go into the issues raised by the petitioners and treat the same as objection against the order dated 02.12.2015. It is directed that no order prejudicial to the interest of respondents No.5&6 shall be passed without hearing them, however, decision on the petitioners' objection shall be taken well in advance and before the due date of election i.e. 24.01.2016.
