***** ARCHANA PURI, J. (Oral) At this stage, counsel for the respondent submits that the compromise has been effected between the parties and in the connected proceedings, relating to the matrimonial dispute, i.e. CRWP-7832-2025, decided on 22.07.2025, the applicant, Palwinder Kaur, had furnished the affidavit, with regard to the arrival of compromise between the parties, copy whereof has been supplied by the counsel for the respondent, which is taken on record.
Perusal of the said compromise/affidavit reveals that in Clause 6 of the said affidavit, she has specifically stated that she is living happily with her husband and the family members.
Also, counsel submits that on the basis of this compromise, the respondent had already filed an application, before learned trial Court for withdrawal of the divorce petition. However, the court has not passed any Sonu 2025.09.10 10:17 I agree to specified portions of this document P&HHC
TA-940-2023 order, keeping in view the stay granted by this court in the present application. Also, counsel submits that if direction is given by this court, the respondent shall withdraw the petition under Section 13 of Hindu Marriage Act , pending before learned trial Court, on the next date of hearing i.e. 17.09.2025.
In view of the submissions made aforesaid, counsel for the applicant submits that even though, he has no knowledge about the arrival of compromise, but however, keeping in view the contents of the compromise, which has been placed on record in the form of affidavit of Palwinder Kaur, on the basis whereof, the protection petition had been disposed of by the Coordinate Bench and more particularly, in view of the undertaking given by the counsel for the respondent, he does not want to pursue with the present transfer application and the same be dismissed, as having become infructuous.
Ordered accordingly.
