CM-4076-CWP-2024 For the reasons mentioned in the application, the same is allowed. Additional affidavit on behalf of respondent Nos.1 and 2 is taken on record subject to all just exceptions.
Main Case 1.
The prayer in the present Civil Writ Petition filed under Articles 226/227 of the Constitution of India, is to issue a writ in the nature of certiorari, mandamus, for directing the respondents to implement the Punjab Adhoc, Contractual, Daily Wage, Temporary, Work Charged and Outsourced Employees Welfare Act, 2016 and regularize the services of the petitioners. 2.
Learned State counsel makes a reference to paras 3 and 4 of the additional affidavit dated 09.01.2024 of Gurmit Kaur, District State Project Director, in view of which, the present petition is rendered infructuous and the same read thus:- HAMANT 2024.03.14 10:20 I attest to the accuracy and integrity of this order/judgment

That the Department of School Education has issued a notification on 09.10.2018 vide which an option was given to the teachers/Principals/Head Masters/Mistress working in the societies (Shiksha Abhiyan Authority, Punjab and Rashhiya Madhyamik Shiksha Abhiyan Authority, Punjab) either to join the department as per Departmental Rules or they could continue to work under their respective societies (now Samagra Shiksha Abhiyan). In view of notification, numbers of teachers, including the petitioners (except Petitioner No. 2 as he died on ) have opted to join the Department of school Education, Punjab. The Condition no. 1 (a) and (b) of notification dated 09.10.2018 has been further amended vide notification dated 07.03.2019 and 08.03.2019, copies of the notifications are appended herewith as Annexure R-1 and Annexure R-2.
4. That in pursuance to the above notification of the State Government, the services of the petitioners (except Petitioner No. 2, who has died on 05.06.2018 and petitioner No. 13 and 30, who have resigned from their post) have been regularized and they are working as regular employees."

He has also produced copies of order dated 29.08.2022 passed in CWP-22370-2014 and other connected cases, wherein the petitions were disposed of, as having been rendered infructuous, in view of the fact that the petitioners had been granted the necessary relief. 4.
Learned counsel for the petitioners is unable to controvert the aforesaid fact.

In view of the above, the present petition is disposed of as having been rendered infructuous.
