Versus
State of Haryana and another -Respondents CORAM: HON'BLE MR. JUSTICE RAJ MOHAN SINGH
Present:
Mr. Sandeep Goyat, Advocate, for the petitioner.
**** RAJ MOHAN SINGH, J. (Oral) Learned counsel for the petitioner relies upon order dated 31.08.2022 passed in a bunch matter with lead case as CWP No.19413 of 2022 to contend that in similarly situated cases, the Co-ordinate Bench has disposed of all the cases by allowing the employees to continue at the present place of posting till their representations are decided in accordance with law.
Grievance of the petitioner is that the petitioner has secured 52.51 points. Petitioner is working in GGMS, Ratera as TGT Sanskrit teacher. Petitioner has participated in the transfer drive 2022 and has secured the aforesaid marks/points. Petitioner has filled up 62 number of stations in order of her
-2preference. Details of schools allotted to the petitioner have also been uploaded on MIS account of the petitioner. In the aforesaid transfer drive 2022, Govt. Girls Senior Secondary School Pabra, District Hisar has been allotted to the petitioner. The aforesaid school falls under Zone-6 of School Code 1467. The aforesaid school was at serial no.61 of the choice of the petitioner. Grouse of the petitioner is that the choiced institution from serial no.1 to 60 have been allocated to those 23 teachers who have secured less marks than the petitioner. Precisely for this grievance, petitioner has already moved a representation before the Director General, Department of School Education, Haryana on 28.08.2022 through e-mail.
In view of aforesaid factual domain which is also subject to verification of the respondent- department, I deem it appropriate to dispose of the present writ petition in terms of CWP No.19413 of 2022.
It is made clear that the order dated 31.08.2022 was passed in CWP No.19413 of 2022 on an assertion that the petitioners therein have not been relieved from their present places of posting. If the petitioner is also not relieved from the present place of posting so far, then the aforesaid order dated 31.08.2022 shall also apply to the case of the petitioner.
-3If the petitioner is already relieved from the place of posting, then the interim order shall not be available to the petitioner.
