CRM-M-32311-2026 --1-- 107 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CRM-M-32311-2026 Decided on:-02.06.2026 Shamsher Singh ....Petitioner..

vs.

State of Punjab ....Respondent.

CORAM:

HON'BLE MR. JUSTICE HARKESH MANUJA

Present:

Mr. Raghav Soni, Advocate for the petitioner. ***** HARKESH MANUJA J. (Oral) 1.

By way of present petition filed under Section 483 of BNSS (439 of Cr.P.C.), prayer has been made for grant of interim regular bail to the petitioner for a period of 1 month, in case bearing FIR No.78, dated 11.03.2026 registered under Section 69 of BNS (375 IPC), at Police Station Gharinda, Amritsar Rural, to enable the petitioner to perform marriage with complainant, namely, Rekha.

2.

Learned counsel for the petitioner submits that the petitioner has been implicated on the allegations that he established physical relations with the complainant on the pretext of marriage. He further contends that there is no other case registered against the petitioner. 3.

The complainant has joined the proceedings through video conferencing and has been duly identified by learned counsel for the petitioner. She made a statement that the marriage between her and the petitioner is now fixed for 06.06.2026 and she has no objection, in case, the petitioner is released on interim regular bail. CRM-M-32311-2026 --2-- 4.

Upon advance notice, Mr. Gunjan Mehta, Addl. A.G., Punjab appears on behalf of respondent and does not dispute the aforesaid facts. 5.

I have heard learned counsel for the parties and gone through the paper book and find substance in the submissions made on behalf of the petitioner.

6.

Admittedly, with the intervention of respectable persons and family members, both the families have now amicably resolved their dispute and have agreed to solemnize the marriage between the complainant and the present petitioner, which is fixed for 06.06.2026. Even, the complainant has joined the proceedings through video conferencing and has admitted the factum of the proposed marriage and has expressed no objection to the grant of interim regular bail to the petitioner. Furthermore, it is not disputed that the petitioner is not involved in any other criminal case. 7.

Without commenting anything on the merits of the case, lest it may prejudice the trial, the present petition is allowed and the petitioner is ordered to be released on interim regular bail for a period of one (01) month from the date of his release on his furnishing adequate bail/surety bonds to the satisfaction of the concerned Trial Court/Duty Magistrate. 8.

It is made clear that this order may not be construed as an expression of opinion on the merits of the case. 02.06.2026 (HARKESH MANUJA) sonika JUDGE Whether speaking/reasoned:
