The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 seeking quashing of order of warrants of arrest issued against the petitioner, dated 29.01.2025 (Annexure P-3) passed by learned Judge, Special Court, Ludhiana in case No.NDPS/34/2023 arising out of FIR No.157 dated 25.09.2022 under Sections 15 and 18 of NDPS Act, 1985 Act, registered at Police Station Sadar Khanna, Ludhiana. 2.

Learned counsel for the petitioner contends that the surety namely Asha Rani filed an application to withdraw her surety for the petitioner-accused. He further states that no opportunity was given to the petitioner to present his fresh surety and warrants of arrest were issued wrongly against him without giving him any opportunity to present fresh surety.  3.

I have heard learned counsel for the parties and perused the material placed on record.

Keeping in view the facts and circumstances of the case and limited prayer made by the counsel for the petitioner, this Court does not find any legitimate ground to interfere in the impugned order dated 29.01.2025 passed by learned Judge, Special Court, Ludhiana. The present petition is disposed of with a direction to the petitioner to appear and surrender before the trial Court concerned within a period of 07 days from today at 10.00 A.M. alongwith fresh surety and may file application for bail before the trial Court. The same be considered and decided by the trial Court concerned on the same day, in accordance with law.
